We handle personal information in accordance with applicable UK data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

4. Information We May Collect About Residents

To assess needs and provide safe, appropriate and person-centred residential care, we may collect information such as:

  • Name, address, date of birth and contact information.
  • Next-of-kin and emergency contact details.
  • Details of relatives, advocates, attorneys, deputies or representatives.
  • Health conditions, diagnoses, disabilities, allergies and medical history.
  • Medication and medication administration information.
  • GP, pharmacy and other health and social care professional details.
  • Care assessments, care plans, reviews and daily care records.
  • Mobility, moving and handling and falls-risk information.
  • Communication, sensory and accessibility needs.
  • Mental capacity assessments and best-interest decision information where applicable.
  • DNACPR or advance-care information where appropriate and forming part of care records.
  • Safeguarding information and risk assessments.
  • Nutrition, hydration, continence and skin-integrity information where relevant.
  • Religious or philosophical beliefs and other information relevant to person-centred care.

5. Special Category Information

Residential care involves processing particularly sensitive information, especially information concerning health. This is known as special category personal data.

We only process special category information where an appropriate lawful basis and condition under UK data protection law applies. For information necessary to provide or manage care, this may include the health or social care condition under Article 9 of the UK GDPR.

Staff who need access to confidential information to provide care are expected to maintain confidentiality and only access information necessary for their role.

6. Relatives and Representatives

We may hold names, addresses, telephone numbers, email addresses, relationships to the resident and information concerning the authority of relatives, next of kin, attorneys, deputies, advocates and other representatives.

We use this information to communicate appropriately about care, welfare and arrangements, subject to the resident’s wishes, capacity, confidentiality requirements and applicable law.

7. Where We Obtain Information

Information may come directly from residents and representatives or from organisations and people involved in arranging or providing care, including local authorities, NHS organisations, GPs, hospitals, pharmacies, nurses, social workers, commissioners, safeguarding teams, previous care providers, advocates, attorneys and family members.

8. How We Use Personal Information

We may use personal information to:

  • Respond to enquiries and arrange assessments or visits.
  • Assess whether Autumn House can safely and appropriately meet a person’s needs.
  • Manage admissions and transitions into the home.
  • Create, maintain and review individual care plans.
  • Provide safe, personalised and person-centred residential care.
  • Support residents with personal care and daily living.
  • Manage and administer medication where this forms part of care.
  • Monitor health, wellbeing, nutrition, hydration and other relevant care needs.
  • Communicate with residents and authorised relatives or representatives.
  • Liaise with health and social care professionals.
  • Make reasonable adjustments and meet communication needs.
  • Manage risks, accidents, incidents and emergencies.
  • Meet safeguarding responsibilities.
  • Support appropriate decision-making where a resident may lack capacity.

  • Meet legal, contractual and regulatory obligations.
  • Maintain appropriate records and manage fees, funding and invoices.
  • Establish, exercise or defend legal claims where necessary.

9. Lawful Bases

Depending on the purpose and circumstances, NUcare Group Ltd may rely on lawful bases including contract, legal obligation, legitimate interests, vital interests and consent.

Where special category information is processed, an additional Article 9 condition must apply. For health and care information required to provide or manage residential care, the health or social care condition may apply.

Consent will only be relied upon where it is the appropriate basis. We do not assume consent is required for every use of health or care information.

10. Who We May Share Information With

Where appropriate and lawful, information may be shared with GPs, pharmacies, healthcare professionals, hospitals, NHS organisations, social workers, local authorities, commissioners, safeguarding teams, emergency services, the Care Quality Commission and other regulators, authorised representatives, advocates, attorneys or deputies, professional advisers, insurers, contracted IT and care-management system providers, and law enforcement or courts where disclosure is legally required or permitted.

We do not sell residents’ personal information.

11. Visitors to Autumn House

We may collect limited visitor information for safety, security, infection prevention, safeguarding or operational purposes, such as a visitor’s name, contact information, person being visited and arrival or departure information.

If CCTV is operated at Autumn House, appropriate signage and separate privacy information should be provided. This notice does not assume CCTV is currently in use.

12. Photographs and Activities

Photographs or recordings may sometimes be taken for care-related purposes, activities, displays, newsletters, publicity or social media.

Where consent is the appropriate basis, relevant permission will be obtained before identifiable photographs or recordings are used for that purpose.

13. Keeping Information Secure

NUcare Group Ltd takes appropriate technical and organisational measures to protect personal information against unauthorised access, loss, misuse, alteration or disclosure.

Access is restricted to staff and authorised persons with an appropriate reason to access information. Staff are expected to respect residents’ confidentiality and comply with data protection and information-security requirements.

We maintain procedures for responding to suspected personal data breaches and will make notifications where legally required.

14. How Long We Keep Information

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected and to meet applicable legal, regulatory, contractual, insurance and record-keeping requirements.

Different records may have different retention periods. When information is no longer required, it will be securely deleted, destroyed or anonymised in accordance with our retention arrangements.

We will take account of appropriate legal authority held by an attorney or deputy and involve representatives or advocates where appropriate, while respecting the resident’s rights, dignity and confidentiality.
